These Terms & Conditions ("Terms") constitute a legally binding agreement governing access to and use of Ekatraa.com ("Ekatraa", "Platform", "Website", "Company", "we", "us", "our"), a Dubai-based multi-designer fashion, lifestyle, and luxury marketplace operating from the United Arab Emirates (UAE).
These Terms are drafted strictly in accordance with the laws of the UAE and the Emirate of Dubai, and are designed to safeguard the commercial, legal, intellectual, and reputational interests of Ekatraa, while defining fair and transparent obligations for buyers/customers ("Customer"), designers/brands/vendors ("Seller"), partners, and all users (collectively, "Users").
By accessing, browsing, registering, listing products, making payments, or placing orders on Ekatraa.com, you expressly acknowledge and agree to be bound by these Terms, together with the Privacy Policy, Refund / Cancellation / Exchange Policy, and any other policies published on the Platform.
1. Legal Status & Platform Authority
1.1 Jurisdiction & Governing Law
This Platform is owned, operated, and controlled from Dubai, United Arab Emirates. All transactions, use of the Platform, and disputes shall be governed exclusively by the laws of the UAE, as applicable in the Emirate of Dubai.
1.2 Right to Operate & Modify
Ekatraa reserves the absolute right, at its sole discretion, to:
- Operate, modify, suspend, restrict, or discontinue the Platform or any part thereof
- Change business models, offerings, features, pricing structures, or policies
- Refuse service to any User without obligation to provide reasons, where permitted by law
2. Eligibility, Capacity & Compliance
2.1 Users must be 18 years or older and legally capable of entering binding contracts under UAE law.
2.2 Users accessing the Platform from outside the UAE do so at their own risk and are responsible for compliance with local laws.
2.3 Use of the Platform for any unlawful, fraudulent, misleading, abusive, or competitive intelligence purposes is strictly prohibited.
3. Accounts & Security
3.1 Account registration may be required for certain services.
3.2 Users are solely responsible for safeguarding login credentials and all activities conducted through their account.
3.3 Ekatraa reserves the right to suspend, restrict, or terminate accounts immediately in cases of suspected fraud, abuse, policy violation, or legal risk—without prior notice.
4. Marketplace Model & Disclaimer
4.1 Ekatraa operates as a curated marketplace facilitator. Unless explicitly stated, Ekatraa is not the manufacturer, owner, or seller of products listed.
4.2 Sellers are independently responsible for product authenticity, quality, pricing, descriptions, dispatch, and compliance with UAE and international trade laws.
4.3 Handcrafted and designer products may show minor variations in color, texture, embroidery, or finish, which shall not be considered defects.
5. Product Listings, Pricing & Errors
5.1 All product information is provided by Sellers and displayed for convenience only.
5.2 Ekatraa reserves the right to:
- Correct typographical, pricing, or listing errors
- Cancel orders affected by such errors
- Modify or remove listings without liability
5.3 Prices may be exclusive of shipping, customs duties, VAT, or other government levies unless expressly stated.
6. Orders, Payments & Financial Terms
6.1 Orders are confirmed only upon successful payment authorization and order acknowledgement.
6.2 Payments are processed via licensed third-party payment gateways compliant with UAE regulations. Ekatraa does not store card or banking data.
6.3 Customers are solely responsible for:
- Accuracy of billing and shipping details
- Customs clearance, import duties, VAT, or foreign taxes for international orders
7. Shipping, Delivery & Risk Transfer
7.1 Delivery timelines are estimates only and may vary due to logistics, customs, public holidays, or force majeure events.
7.2 Risk of loss and title pass to the Customer upon delivery to the specified address.
7.3 Ekatraa shall not be liable for delays caused by incorrect information provided by Customers or third-party logistics partners.
7.4 Any delay for any reason, Ekatraa can’t be held responsible for the same.
8. Cancellation, Refunds & Exchanges
All matters relating to cancellation, refunds, and exchanges are governed exclusively by Ekatraa’s Refund / Cancellation / Exchange Policy, which forms an integral part of these Terms and is legally binding.
9. Seller Obligations & Platform Enforcement
Sellers agree to:
- List only authentic, lawful products
- Comply with UAE consumer protection, trade, customs, and VAT laws
- Fulfil approved exchange or refund requests
- Cooperate with audits, investigations, and dispute resolution
Ekatraa may impose penalties, suspend payouts, delist products, or terminate Seller access for non-compliance.
10. Intellectual Property & Platform Rights
10.1 All Platform content, software, design, trademarks, logos, and proprietary material are the exclusive property of Ekatraa or its licensors.
10.2 Unauthorized use, scraping, reverse engineering, or reproduction is strictly prohibited.
10.3 Sellers grant Ekatraa a worldwide, royalty-free, perpetual license to use product images, videos, and descriptions for marketing, PR, analytics, and platform operations.
11. User Content, Reviews & Communications
11.1 Users may submit reviews or feedback subject to moderation.
11.2 Ekatraa reserves the unrestricted right to remove, edit, or suppress content without liability.
11.3 All communications through the Platform may be monitored or recorded for quality, compliance, and legal protection.
12. Promotions, Events & Offline Sales
12.1 Special terms may apply to promotions, pop-ups, exhibitions, or offline events.
12.2 Purchases made at physical events may be subject to separate disclosed policies, which shall prevail in case of conflict.
13. Limitation of Liability
To the maximum extent permitted under UAE law:
- Ekatraa shall not be liable for indirect, incidental, consequential, or punitive damages
- Platform liability, if any, is strictly limited to facilitation of dispute resolution
- Seller liability is capped at the value of the product sold
14. Indemnity
Users agree to indemnify and hold harmless Ekatraa, its owners, directors, officers, employees, and partners against any claims, losses, penalties, or damages arising from:
- Breach of these Terms
- Violation of applicable laws
- Infringement of third-party rights
15. Force Majeure
Ekatraa shall not be liable for failure or delay caused by events beyond reasonable control, including natural disasters, pandemics, government actions, supply chain disruptions, or internet failures.
16. Suspension & Termination
Ekatraa may suspend or permanently terminate access to the Platform, accounts, or services without notice where required to protect legal, commercial, or security interests.
17. Dispute Resolution & Jurisdiction
All disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates. Users expressly waive any objection to such jurisdiction.
18. Amendments & Continuity
Ekatraa reserves the right to amend these Terms at any time. Continued use of the Platform constitutes binding acceptance of the revised Terms.
